  • Distracted Driving: In today’s increasingly digitized society, a growing percentage of car accidents are caused by driver inattentiveness and distractions. T
  • Driving while Drowsy or Fatigued: People who drive for a living, work long hours, and work overnight hours are especially prone to driving when they are fatigued and have not had enough sleep.
  • Chemical Impairment: As mentioned earlier, there is a lot of alcohol consumed in the casinos and other establishments along Mississippi’s Gulf Coast, and many accidents in Ocean Springs and nearby communities can be attributed to drunk driving.

Compensatory damages are designed to repay the victim for the losses they have suffered. These are generally divided into two categories: Economic Damages (quantifiable financial losses) and Non-Economic Damages (subjective, intangible losses).

  1. Economic Damages: The Tangible Costs

Economic damages are the foundation of your claim because they can be proven with receipts, invoices, and pay stubs.

  • Medical Expenses: This includes every cost associated with your physical recovery. In Ocean Springs, this might range from the initial ambulance ride to Singing River Hospital, to ER visits, surgeries, and ongoing physical therapy. Because of this rule, insurance companies often work hard to shift even a small amount of blame onto the victim to lower their payout.

Statutory Caps and Punitive Damages

While Mississippi does not cap economic damages (you can recover the full cost of your medical bills and lost wages), there are legal limits on other types of recovery.

Non-Economic Damage Caps

In most civil actions in Mississippi, non-economic damages (pain and suffering) are capped at $1,000,000. However, for cases involving “catastrophic” injuries filed after January 1, 2025, new legislation (such as HB 548) may allow for higher limits depending on the specific nature of the injury and its impact.

Punitive Damages

In rare and limited cases, a jury may award punitive damages. Unlike compensatory damages, these are not intended to “repay” the victim, but rather to punish the defendant for behavior that was willful, malicious, or grossly negligent (such as a high-speed drunk driving accident).

Mississippi law places strict caps on punitive damages based on the net worth of the defendant:

  • For defendants with a net worth of $50 million or less, punitive damages are capped at 2% of their net worth.
  • The cap scales up significantly for massive corporations, reaching as high as $20 million for defendants worth more than $1 billion.

Why Insurance Policy Limits Matter

A case may be “worth” $500,000 based on medical bills and suffering, but if the at-fault driver only carries the Mississippi state minimum liability (currently $25,000 per person), collecting the full value can be difficult.

This is why “Uninsured/Underinsured Motorist” (UM/UIM) coverage on your own policy is so important. If the other driver’s insurance isn’t enough to cover your losses, your own UM/UIM coverage can bridge the gap.

Statute of Limitations for Mississippi Car Accidents

For most auto accident cases in Mississippi, the statute of limitations for filing a claim is three years. However, if your injury was caused by the negligence of a government employee or entity (such as hazardous conditions caused by poorly maintained roads), you must follow a different set of rules, one of which is to file a claim with the state’s Attorney General within 90 days of the accident.
